Regulatory Requirements

Privacy
AVCAT supports and is bound by the Privacy Amendment (Private Sector) Act 2000 and the National Privacy Principles. A copy of the National Privacy Principles can be found at http://www.privacy.gov.au/publications/npps01.html.

In relation to the Long Tan Bursary which AVCAT administers under a Service Contract with the Australian Government, we are bound by the relevant provisions of the legislation which applies to Australian Government instrumentalities, the Privacy Act (Act No 119 of 1988) as amended.

Freedom of Information
AVCAT is not bound by the Freedom of Information legislation which applies to Federal or State instrumentalities.

Ombudsmen
Neither the Commonwealth or State Ombudsmen have jurisdiction in relation to AVCAT.

Review of Decisions
Neither Commonwealth nor State legislation in relation to the review of administrative decisions applies to AVCAT.

Other Regulatory Requirements
As an organisation authorised to raise funds in NSW, AVCAT conforms to the relevant NSW Legislation. That legislation is the (NSW) Charitable Fund Raising Act 1991 and Regulations, as amended.

It obliges AVCAT to have processes for resolving internal disputes between the membership of the organization in relation to its, fund raising activities. The members of AVCAT are the organizations who appoint its directors. The Board has decided that such disputes will be referred to the Board for resolution.

A further requirement is that the authorised fund raiser must provide a mechanism that will properly and effectively deal with complaints from members of the public and employees in relation to its fund raising activities.

Where there are such complaints, it has been decided that they are to be referred to the Board for action.
